Alina Habba has resigned as the chief federal prosecutor in the state. This decision was prompted by a judicial decision that invalidated her right to serve.
Acceptance of Resignation
The nation's top law enforcement official, Pam Bondi, announced the prosecutor's departure on Monday. She commented that the judicial decision made it unworkable for the official to lead the department effectively.
"Do not interpret adherence to the ruling as defeat," she declared. "This battle will now reach across the nation."
Court Ruling
The departure comes a week after a federal appellate panel determined that she had been acting without proper authority as the top prosecutor. This ruling is expected to impact numerous legal proceedings in New Jersey.
The court declared that a temporary posting that skirted the advice and consent of the Senate ran afoul of the Federal Vacancies Reform Act.
Next Steps and Responses
Bondi said that the former prosecutor will remain at the justice department as a top consultant. She will seek further review of the court's action, with hopes of a reversal.
In a statement, she contended that judges "cannot be permitted to second-guess the appointment of lawyers tasked with performing the executive branch's core responsibility of criminal prosecution."
Performance in Office
The attorney general praised the prosecutor's work and said that during her run, the Newark saw a one-fifth decrease in criminal activity. It was also reported that the city of Camden recorded its first summer in half a century without a homicide.
Connection to Donald Trump
The 41-year-old attorney, first joined Donald Trump's lawyers in 2021. Subsequently, she defended Trump in his New York criminal case in 2024, when he was guilty verdict on dozens of charges of financial record manipulation.
Earlier, assuming the federal prosecutor position, Trump had revealed he was naming her as his presidential counsellor in a potential future term, labeling her as deeply loyal and a "tireless advocate for justice".
