US Judge Orders Release of Abrego Garcia from ICE Detention
A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case originates in a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his repatriation to the United States to answer alien smuggling charges, he was held in federal custody.
In her order, the court pointed out that the authorities does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
Background of the Legal Challenge
The legal challenge center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in the state of Tennessee.
Terms of Release
The judge, who was overseeing his petition to deportation in a federal court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This decision shifts his monitoring to the Tennessee court.
This decision marks a significant development in a complex legal case involving claims of mistaken imprisonment and disputed gang associations.
